Meanings and definitions used in these Terms and Conditions:

“GWP” means Greg Williams Photography Limited, registered in England at PO Box 1295, 20 Station Road, Gerrards Cross, Buckinghamshire SL9 8EL with company registration number 04557292;

“Services” means any mobile site, application, podcast, print magazine, book, journal, email newsletter, e-commerce and/or other service related to the Website, regardless of how provided, distributed, communicated, transmitted, published, or broadcast and any related pages and content under our control;

“T&Cs” means these terms of use for users of the Website and the Services; and

“Website” means this website owned and operated by GWP.

1. Introduction
1.1 This Website and the Services are owned, operated and published by GWP.

1.2 These T&Cs govern the use of the Website and the Services.

1.3 The Website and the Services are designed for entertainment and educational purposes and GWP requires its users to abide by these T&Cs. Your use of the Website and the Services will constitute your agreement to comply with these T&Cs.

1.4 If you do not agree with these T&Cs, you should not use the Website or the Services.

1.5 GWP may modify these T&Cs from time to time. Continued use of the Website and the Services by you will constitute your acceptance of any changes or revisions to the T&Cs. Please check this page regularly for any updates.

1.6 We may terminate your access to the Website and the Services, without notice, in addition to our other remedies if you fail to follow these T&Cs.

1.7 From time to time, our Website and the Services may publish articles or features which some site users may find offensive. GWP does not intend to offend, and suggests that users who find the tone or content offensive no longer visit the Website and/or use the Services.

2. Use of the Website and the Services
2.1 GWP or its licensors own all material on the Website and the Services. You may retrieve and display content from this Website on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk (but not on any server or other storage device connected to a network) for your own personal, non-commercial use. You may not in any way make commercial or other unauthorised use, by publication, re-transmission, distribution, performance, caching or otherwise, of material obtained through the Website or the Services.

2.2 You acknowledge that ‘Greg Williams Photography’ and ‘Hollywood Authentic’ are trade marks owned by GWP and that you may not use them without prior written permission from GWP.

2.3 You may not authorise others to use the Website and the Services, and you are responsible for all of your own use of them. You agree not to use any obscene, indecent or offensive language, or to place on the Website any material that is false, defamatory, abusive, harassing or hateful. Further, you may not place on the Website any material that is encrypted, constitutes junk mail or unauthorised advertising, invades anyone’s privacy, encourages conduct that would constitute a criminal offence or give rise to civil liability, or that otherwise violates any local, state, national or international law or regulation. You agree to use the Website and the Services only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and/or criminal liability.

2.4 You are responsible for all activities under your password or account, and you must keep your password confidential. You must immediately notify us of any unauthorised use of your password or account or any other breach of security. You must not disrupt the functioning of the Website or the Services, solicit or use another user’s password or otherwise act in a way that interferes with other users’ use of the Website or the Services.

2.5 Other than connecting to GWP’s servers by HTTP requests using a web browser, you may not attempt to gain access to GWP’s servers by any means, including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Website the Services or otherwise.

2.6 You are responsible for ensuring that any material you provide to the Website and the Services, including but not limited to text, photographs and sound, does not violate the copyright, trade mark, trade secret or any other personal or proprietary rights of any third party.

2.7 You agree not to disrupt, modify or interfere with the Website and the Services or any associated software, hardware and servers in any way, and you agree not to impede or interfere with others’ use of the Website and the Services. You further agree not to alter or tamper with any information or materials on, or associated with, the Website or the Services.

2.8 You acknowledge that GWP has not reviewed and does not endorse the content of all sites linked to from the Website, and is not responsible for the content or actions of any other sites linked to or from the Website. Linking to any other service or site from this Website is at your sole risk.

3. Age Requirement
By using the Website and the Services, you confirm that you are 18 years old or more or if you are under 18 years old, that you have received your parent’s or guardian’s consent to enter into these T&Cs.

4. Copyright and related Rights
4.1 All copyright, trademarks, design rights and all other intellectual property rights (registered or unregistered) where relevant in and on the Website and the Services and all content located thereon shall at all times remain vested in GWP or its licensors.

4.2 GWP grants you a limited, non-exclusive, revocable, non-transferable licence to use the Website and the Services content solely for personal use. Except as expressly set out herein, neither you nor anyone acting on your behalf acquires any intellectual property rights relating to any such content. Any rights not expressly granted within these T&Cs are reserved to GWP.

4.3 By sharing any contribution(s) with us  to the Website or the Services, you agree and grant GWP and its sub-licensees free-of-charge permission to use the contribution(s) at GWP’ sole discretion (including modifying and adapting it for operational and editorial reasons) in connection with the operation of the Website or the Services and our business. The licence extends to copying, distributing, broadcasting, publishing or otherwise transmitting, adapting or editing the contribution(s).

4.4 You agree and confirm that any contribution(s) you provide or upload is original to you and does not infringe any relevant law, copyright or other rights of any other person, or that you have the consents necessary to provide the contribution(s) to GWP.

4.5 You acknowledge that GWP does not endorse the accuracy, integrity, copyright, compliance, legality, quality or decency of any contribution(s). Users may respond to or comment upon contribution(s), such comments do not necessarily represent the views or opinions of GWP.

4.6 GWP respects the intellectual property of others, and we ask our users to do the same. GWP may, in appropriate circumstances and at its discretion, terminate the access of users, subscribers, and account holders who infringe the copyright or any related rights of GWP and of its licensors.

4.7 If you believe that your work has been copied and is accessible on any GWP Website or the related Services in a way that constitutes copyright infringement, or that the Website contains links or other references to another online location that contains material or activity that infringes your copyright, please contact GWP immediately.

5. E commerce
5.1 Shipping and Delivery
5.1.1 We advise on a delivery period of up to two (2) to three (3) weeks for items or products purchased. We reserve the right to make an additional charge for any expedited delivery. International orders may take longer especially to the EU due to the impact of Brexit.

5.1.2 All items are listed at retail value. Shipping is free on orders over five hundred pounds sterling (£500), otherwise we will notify you of relevant shipping costs. We may request that you cover any re-delivery costs where we have not been able to deliver because of incorrect or incomplete information provided to us. Overseas shipping costs and customs duties on imports will be additional and will be at your cost.

5.2 Return Policy
Our return policy is applicable for fourteen (14) days after you have received your order. If fourteen (14) days have gone by since receipt, unfortunately we can’t offer you refunds or exchanges. This is in addition to your statutory rights.

5.2.1 Refunds
i) If you are unhappy with your purchase you may return it in its original condition for a refund, provided it is returned within fourteen (14) days from receipt by you of your order. Shipping costs will not be refunded. Please contact [email protected] for further instructions.

ii) To be eligible for a refund, your item must be unused, undamaged and in the same condition that you received it. It must also be in the original packaging.

iii) Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. Provided the item is unused, undamaged and in the same condition as you received it, we will grant a refund. This will occur via a credit being automatically applied to your credit card or original method of payment.

5.2.2 Exchanges
i) Exact exchanges will be made on damaged or defective products. If a product arrives damaged, you must keep all original packaging material for insurance purposes. Claims must be made within fourteen (14) days of receipt of your order via email to [email protected]

ii) In the event of an exchange or refund, please print off your order confirmation form which includes your unique Order Number and return it with the damaged or defective item to the following address:

iii) In addition to insuring your return, we strongly recommend that the order be sent with Delivery Confirmation. Should we not receive your return, we will not be able to issue a refund or exchange as appropriate. Refunds on returns will be issued on the price of the merchandise and any sales tax, if applicable. If the purchase is made in a currency other than GBP £, a refund will be based on the daily rate of the date of purchase.

iv) You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. We will not charge you for any further shipping costs on exchanges where we send replacement goods.

v) Items that are returned to us as undeliverable or returned after three (3) delivery attempts will be treated as a return. Shipping will be charged again upon the request of an order re-shipment. We will try and contact you three (3) times through the email address provided with your order. If two (2) months have passed, and we have not received a response from you, your item will be returned-to-stock, and you will be refunded for the product cost, but not the shipping costs, associated with this order.

5.2.3 Late or Missing Refunds (if applicable)
i) If you haven’t received a refund yet, first double check your account. Then contact your credit card company, as it may take some time before your refund is processed.

ii) If you’ve done all of this and you still have not received your refund, please contact us at [email protected]. Depending on where you live, the time it may take for your exchanged product to reach you may vary.

5.2.4 Delivery Gone Missing
If your order seems to be lost in the mail, please notify us by email at [email protected] no later than three (3) weeks for domestic orders, and five (5) weeks for international orders, after having received your shipping notification. We will do our best to work with you and the shipping service to locate your package, and/or send you a replacement. Unfortunately, we are unable to assist after this time frame has passed.

5.2.5 Third Party Suppliers
From time to time GWP may team up with other selected third parties to offer you the opportunity to purchase goods from the Website and the Services. Such purchases will be with the named third party (and not with GWP) and will be governed by the terms and conditions notified to you at the time of purchase. GWP cannot and does not accept any responsibility or liability for any losses you may suffer as a result of entering into any transaction with any third party.

6. Indemnity
You agree to indemnify GWP and its subsidiaries, affiliates, officers, employees, advertisers, partners, agents and representatives, and to hold them harmless from any and all claims, demands, liabilities, damages, costs and expenses (including legal fees) that may arise from: (i) your submissions, contribution(s) or provision of content; (ii) your use or misuse of the Website and the Services; (iii) your unauthorised use of material obtained through the Website and the Services; (iv) your breach of these T&Cs; or (v) any other violation of the rights of another person or party.

7. Disclaimers and Limitation of Liability
7.1 ANY INFORMATION OFFERED ON OR THROUGH THE WEBSITE AND THE SERVICES BY GWP AND ANY THIRD-PARTY SITES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. IN RELATION TO SUCH INFORMATION, TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE WEBSITE OR ANY OF ITS FUNCTIONS NOR ANY SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THIS WEBSITE AND ANY SERVICES, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS.

7.2 IN NO EVENT SHALL GWP OR ITS LICENSORS, VENDORS, SUPPLIERS, SERVICE PROVIDERS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, SUB-CONTRACTORS, AGENTS, AND REPRESENTATIVES, BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, THE INTERNET OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE WEBSITE AND THE SERVICES, INCLUDING FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE WEBSITE OR SUCH SERVICES, YOUR USE OF OR RELIANCE ON THE WEBSITE OR THE SERVICES OR ANY OF THE INFORMATION OR MATERIALS AVAILABLE ON THEM, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 7.3 GWP’S LIABILITY WILL NOT BE LIMITED IN THE CASE OF DEATH OR PERSONAL INJURY DIRECTLY CAUSED BY GWP’S’ NEGLIGENCE.

8. Termination
GWP HAS THE RIGHT TO TERMINATE YOUR ABILITY TO ACCESS THE WEBSITE AND THE SERVICES, FOR ANY REASON, WITHOUT NOTICE.

9. Privacy
The information that you provide about yourself to GWP will only be used by GWP in accordance with its Privacy Policy available below. The Privacy Policy does not apply to third party sites.

10. Online Safety
Please remember that posting your name, contact information or any other personal information on the Website places such information in the public domain. Always use caution when giving out information. We advise that you do not reveal any information about yourself or anyone else (for example: full name, telephone number, postal address, email address, home address or any other details that allow you to be personally identified) on the Website.

11. Links
11.1 Any third party website that links to this Website must not:

i) create a frame or any other browser or border environment around the content of this Website;

ii) imply that GWP is endorsing it or its products or services;

iii) use any GWP trade mark or those of its licensors displayed on the Website or the Services without permission from GWP or its licensors;

iv) infringe any intellectual property or other right of any person; or

v) be a website that contains content that could be construed as distasteful, offensive or controversial.

11.2 GWP expressly reserves the right to request that any link in breach of these T&Cs be removed and to take whatever other action it deems appropriate.

11.3 On this Website you may be offered automatic links to other sites. While GWP hopes you will be interested in those other sites, you acknowledge that their owners may be independent from GWP and GWP does not endorse or accept any responsibility for their content.

11.4 Pages of the Website may contain some contextual affiliate marketing links created by third parties. Purchases made on these third party sites are the sole responsibility of that site. Purchases made through these links may result in a commission being earned by GWP.

12. Miscellaneous
12.1 These T&Cs together with any additional terms which are drawn to your attention constitute the complete and entire agreement between the parties and supersede any prior agreement, whether written or oral.

12.2 If any provision of these T&Cs is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these T&Cs, which shall remain in full force and effect.

12.3 These T&Cs are not intended to benefit or be enforceable by any third party and the Contracts (Rights of Third Parties) Act 1999 shall not apply.

12.4 Failure of either party to exercise any right or remedy under these T&Cs does not constitute a waiver of that right or remedy.

12.5 You agree that these T&Cs, for all purposes, shall be governed by and construed in accordance with English law. You also agree, subject to the following clause, to submit to the exclusive jurisdiction of the English courts as regards any claim or matter arising under these T&Cs.

12.6 For the exclusive benefit of GWP, GWP shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence.
